Acest contract preliminar este diferit de contractul efectiv de v\u00e2nzare-cump\u0103rare \u0219i trebuie s\u0103 respecte at\u00e2t condi\u021biile de fond (capacitate, consim\u021b\u0103m\u00e2nt, obiect, cauz\u0103), c\u00e2t \u0219i pe cele de form\u0103, conform legisla\u021biei \u00een vigoare la momentul \u00eencheierii sale, potrivit principiului \u201etempus regit actum\u201d.<\/p>\n\n\n\n<p>Pe scurt, promisiunea sinalagmatic\u0103 creeaz\u0103 un drept de crean\u021b\u0103 pentru fiecare parte, corelativ obliga\u021biei celeilalte de a \u00eencheia contractul promis.
