Distinc\u021bia \u00eentre uzucapiunea de lung\u0103 durat\u0103 \u0219i cea de scurt\u0103 durat\u0103 ofer\u0103 solu\u021bii flexibile at\u00e2t pentru posesorii care nu au un titlu juridic, c\u00e2t \u0219i pentru cei care, de\u0219i au ac\u021bionat de bun\u0103-credin\u021b\u0103, s-au bazat pe titluri cu vicii. \u00cen ansamblu, noua reglementare asigur\u0103 protec\u021bia at\u00e2t a drepturilor posesorilor, c\u00e2t \u0219i a intereselor legitime ale proprietarilor, contribuind la stabilitatea raporturilor juridice imobiliare.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00cen noul Cod civil rom\u00e2n (NCC), intrat \u00een vigoare la 1 octombrie 2011, uzucapiunea este reglementat\u0103 \u00eentr-o manier\u0103 detaliat\u0103, stabilindu-se dou\u0103 forme principale: uzucapiunea de scurt\u0103 durat\u0103 (denumit\u0103 \u0219i tabular\u0103) \u0219i uzucapiunea de lung\u0103 durat\u0103.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Uzucapiunea de lung\u0103 durat\u0103 (art. 930-934 NCC)<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Uzucapiunea de lung\u0103 durat\u0103 este cea mai frecvent\u0103 form\u0103 de dob\u00e2ndire a dreptului de proprietate prin posesie continu\u0103. \u00cen acest sens, NCC prevede urm\u0103toarele condi\u021bii esen\u021biale pentru a putea invoca uzucapiunea de lung\u0103 durat\u0103:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>&nbsp;a) Posesia util\u0103<\/em><\/strong>: Posesia trebuie s\u0103 fie util\u0103, adic\u0103 s\u0103 \u00eendeplineasc\u0103 cumulativ urm\u0103toarele caractere:&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Public\u0103<\/em><\/strong> : Posesia trebuie s\u0103 fie cunoscut\u0103 de c\u0103tre ter\u021bi, nu clandestin\u0103. Posesorul trebuie s\u0103 ac\u021bioneze \u00een mod deschis, ca un adev\u0103rat proprietar, \u0219i nu pe ascuns.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Ne\u00eentrerupt\u0103<\/em><\/strong>: Posesia nu trebuie s\u0103 fie \u00eentrerupt\u0103 pe parcursul termenului de uzucapiune. Dac\u0103 exist\u0103 \u00eentreruperi semnificative, acestea pot stopa curgerea termenului, iar uzucapiunea nu se va putea invoca.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Netulburat\u0103<\/em><\/strong>: Posesorul nu trebuie s\u0103 fie tulburat sau \u00eempiedicat constant de alte persoane \u00een exercitarea posesiei. Dac\u0103 exist\u0103 conflicte permanente cu privire la bunul posedat, acest lucru poate \u00eempiedica invocarea uzucapiunii.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Sub nume de proprietar<\/em><\/strong>: Posesia trebuie exercitat\u0103 \u00een numele posesorului \u00eensu\u0219i, care trebuie s\u0103 se comporte ca \u0219i cum ar fi adev\u0103ratul proprietar. \u00cen situa\u021bia \u00een care posesorul recunoa\u0219te \u00een mod explicit dreptul altuia, uzucapiunea nu va putea fi invocat\u0103.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&nbsp;b) Bunul s\u0103 fie susceptibil de uzucapiune<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nu toate bunurile pot face obiectul uzucapiunii. De exemplu, bunurile din domeniul public al statului sau al unit\u0103\u021bilor administrativ-teritoriale sunt inalienabile \u0219i imprescriptibile, deci nu pot fi dob\u00e2ndite prin uzucapiune. Numai bunurile din domeniul privat pot fi supuse acestei proceduri.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&nbsp;c) Durata posesiei<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Termenul necesar pentru invocarea uzucapiunii de lung\u0103 durat\u0103 este de 30 de ani. Acesta se calculeaz\u0103 de la momentul \u00een care posesorul a \u00eenceput s\u0103 exercite posesia util\u0103 asupra bunului. Dup\u0103 trecerea acestui termen, posesorul poate dob\u00e2ndi dreptul de proprietate asupra imobilului, chiar dac\u0103 nu a avut un titlu formal de proprietate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&nbsp;2. Uzucapiunea de scurt\u0103 durat\u0103 (tabular\u0103) (art. 931 NCC)<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Uzucapiunea de scurt\u0103 durat\u0103, denumit\u0103 \u0219i uzucapiune tabular\u0103, are ca principal\u0103 condi\u021bie existen\u021ba unei \u00eenscrieri \u00een cartea funciar\u0103 \u0219i este reglementat\u0103 pentru a proteja acele situa\u021bii \u00een care o persoan\u0103 de bun\u0103-credin\u021b\u0103 intr\u0103 \u00een posesia unui imobil, baz\u00e2ndu-se pe un titlu juridic, \u00eens\u0103 dreptul s\u0103u nu a fost \u00eenscris sau a fost \u00eenscris necorespunz\u0103tor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&nbsp;a) Posesia de bun\u0103-credin\u021b\u0103<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pentru a invoca uzucapiunea de scurt\u0103 durat\u0103, este necesar ca posesorul s\u0103 fie de bun\u0103-credin\u021b\u0103, adic\u0103 s\u0103 fi intrat \u00een posesia bunului \u00een baza unui titlu aparent valabil, dar care ulterior s-a dovedit a fi nul, inexistent sau afectat de vicii. Posesorul trebuie s\u0103 fi crezut, \u00een mod rezonabil, c\u0103 titlul s\u0103u \u00eei confer\u0103 dreptul de proprietate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&nbsp;b) \u00censcrierea posesiei \u00een cartea funciar\u0103<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Posesia trebuie s\u0103 fie \u00eenscris\u0103 \u00een cartea funciar\u0103, \u00een condi\u021biile \u00een care imobilul este supus acestui regim. \u00cen lipsa acestei \u00eenscrieri, uzucapiunea de scurt\u0103 durat\u0103 nu va putea fi invocat\u0103.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>c) Durata posesiei<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Termenul de posesie necesar pentru invocarea uzucapiunii de scurt\u0103 durat\u0103 este de **10 ani**, conform noului Cod civil. Acest termen \u00eencepe s\u0103 curg\u0103 de la momentul \u00eenscrierii posesiei \u00een cartea funciar\u0103. Dup\u0103 \u00eemplinirea acestui termen, posesorul poate dob\u00e2ndi dreptul de proprietate asupra imobilului, chiar dac\u0103 titlul s\u0103u a fost declarat nul.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3. Efectele uzucapiunii<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prin invocarea uzucapiunii, posesorul dob\u00e2nde\u0219te **dreptul de proprietate** asupra imobilului, cu toate efectele juridice ce decurg din aceasta. Proprietatea dob\u00e2ndit\u0103 prin uzucapiune este deplin\u0103, iar orice alt drept anterior al altor persoane asupra bunului \u00eenceteaz\u0103.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00cen cazul uzucapiunii de scurt\u0103 durat\u0103, aceasta are un rol important \u00een consolidarea securit\u0103\u021bii juridice, protej\u00e2nd persoanele de bun\u0103-credin\u021b\u0103 care au intrat \u00een posesia unui imobil pe baza unui titlu aparent valabil.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4. Suspendarea \u0219i \u00eentreruperea termenului de uzucapiune<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00cen anumite situa\u021bii, termenul de uzucapiune poate fi suspendat sau \u00eentrerupt. Suspendarea are loc \u00een situa\u021bii excep\u021bionale, cum ar fi imposibilitatea temporar\u0103 de a exercita posesia din cauza unor for\u021be majore. \u00centreruperea termenului are loc atunci c\u00e2nd posesorul este \u00eempiedicat \u00een mod semnificativ s\u0103 exercite posesia, de exemplu, prin acte de tulburare din partea altor persoane.
